FTC Ban On Non-Compete Agreements Struck Down 

On August 20, 2024, a federal judge in Dallas struck down the FTC's rule banning non-compete agreements, ending months of legal uncertainty for employers nationwide. The FTC had issued the rule in April 2024, aiming to void 30 million existing non-compete agreements and scheduled it to take effect on September 4, 2024. The rule would have broadly banned non-compete agreements across all employment types, including employees, independent contractors, and interns, and required companies to inform workers that their non-competes were unenforceable. However, the rule faced multiple legal challenges, leading to conflicting court decisions, including rulings in Texas, Pennsylvania, and Florida.

In the final ruling, the Texas court found that the FTC had overstepped its authority by issuing the Non-Compete Rule, stating that it was unreasonably broad and lacked sufficient evidence to justify a sweeping prohibition. As a result, the rule will not take effect unless the FTC successfully appeals the decision. This ruling marks a significant victory for employers who rely on non-compete agreements to protect their business interests.

Despite this outcome, the attention brought by the rule and subsequent litigation has heightened scrutiny of non-compete agreements nationwide. Several states, such as California, North Dakota, and Oklahoma, already prohibit non-competes in most employment contexts. Minnesota recently joined them by banning workplace non-competes in 2023.
